These Terms of Use ("Terms") govern your access to and use of the DigixData website at https://digixdata.com and the content, features, and offerings we make available through it. Please read them carefully, because by using our website you agree to be bound by them.
1. Acceptance of These Terms
By accessing or using the DigixData website (the "Site"), submitting an inquiry through it, or otherwise engaging with our content, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with these Terms, please do not use the Site.
These Terms apply to every visitor and user of the Site. If you use the Site on behalf of a company, organization, or other entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and that entity.
These Terms govern your use of the Site itself. They do not replace or override any separate written agreement you may enter into with us for a specific paid engagement, product, or service; where such an agreement exists, its terms control for that engagement as described in the "Our Services and Offerings" section below.
2. Who We Are and Scope
DigixData is a company based in Frisco, Texas that provides AI-focused keynotes and speaking, workshops, enterprise AI consulting, self-paced courses, a book, and browser extensions and related products. In these Terms, "DigixData," "we," "us," and "our" refer to DigixData.
These Terms are the company-wide terms for the entire DigixData website and business. They are not limited to any single product line. Our browser extensions and plugins are one part of what we offer, and an individual extension may have its own additional or more detailed disclosures, permissions, or terms; where that is the case, those product-specific terms apply to that product in addition to these Terms. Nothing in an extension-specific disclosure narrows the scope of these Terms as they apply to the Site as a whole.
3. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction if that is older, to use the Site and to enter into any agreement with us. By using the Site, you represent and warrant that you meet this requirement and that the information you provide to us is accurate and complete.
The Site is intended for a general business audience. It is not directed to children, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information through the Site, please contact us so we can address it.
4. Our Services and Offerings
Through the Site we describe and, in some cases, make available a range of offerings. These currently include:
- Keynotes and speaking engagements, such as our "RISE of the Agents" talk;
- Workshops for teams and organizations;
- Enterprise AI consulting;
- Self-paced online courses (opening soon);
- Our book, "The Agentic Operator Playbook"; and
- Browser extensions and plugins published by DigixData.
5. Paid Engagements and Third-Party Fulfillment
The descriptions of our offerings on the Site are provided for general information and do not by themselves create a binding contract for services. Specific paid engagements — including speaking bookings, workshops, and consulting projects — are governed by a separate written agreement, statement of work, or order document signed or otherwise agreed to by you and DigixData. If there is any conflict between these Terms and such a written agreement with respect to that engagement, the written agreement controls for that engagement.
Certain products, including our courses, book, and extensions, may be sold, hosted, delivered, or otherwise fulfilled through third-party platforms and marketplaces (for example, an app store, e-book retailer, or course-hosting platform). When you purchase, download, or access a product through a third-party platform, your transaction and your use of that platform are also subject to that platform's own terms of service, privacy practices, pricing, and policies. We do not control those platforms and are not responsible for their acts or omissions. You are responsible for reviewing and complying with the applicable third-party terms.
We may add, change, suspend, or discontinue any offering, feature, or portion of the Site at any time without notice or liability. We are not obligated to keep any particular offering available.
6. Inquiries and Submissions
The Site includes inquiry and lead-capture forms. When you submit a form, you may provide information such as your name, email address, and the content of your message. We use that information to respond to your inquiry and to communicate with you about our offerings, as described in our Privacy Policy. Please review the Privacy Policy to understand how we handle the information you submit.
You are responsible for the accuracy of the information you provide and for ensuring that you have the right to share it. Please do not submit confidential, sensitive, or proprietary information through a Site form, and do not include information about others that you are not authorized to share. Unless we have a separate written agreement that says otherwise, submitting an inquiry does not create a confidential or professional relationship, and any unsolicited ideas, suggestions, or feedback you send us may be used by us without restriction or obligation to you.
7. Intellectual Property and Limited License
The Site and its content — including text, graphics, logos, images, audio, video, course materials, book excerpts, software, and the selection, arrangement, and design of the foregoing (collectively, the "Content") — are owned by DigixData or its licensors and are protected by copyright, trademark, and other intellectual property laws. "DigixData" and our related names, logos, and product names are trademarks or common-law marks (™) of DigixData; nothing on the Site should be read as granting any license or right to use them without our prior written permission.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, personal, non-commercial license to access and view the Content on the Site for your own informational purposes. This license does not permit you to reproduce, republish, distribute, sell, license, publicly display or perform, modify, or create derivative works from the Content, and it does not permit you to scrape, harvest, data-mine, or use automated means to extract or collect the Content, in each case without our prior written permission.

8. Acceptable Use and Prohibited Conduct
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree that you will not:
- Use the Site in any way that violates any applicable law or regulation, or that infringes the rights of DigixData or any third party;
- Copy, scrape, reproduce, distribute, or create derivative works from the Content except as expressly permitted by these Terms or the Copyright page;
- Use any robot, spider, crawler, scraper, or other automated means to access, monitor, or collect Content or data from the Site without our prior written permission;
- Attempt to gain unauthorized access to the Site, its servers, or any related systems or networks, or interfere with or disrupt the integrity, security, or performance of the Site;
- Introduce any virus, malware, or other malicious code, or use the Site to transmit unsolicited or unauthorized advertising or communications;
- Circumvent, disable, or otherwise interfere with any security or access-control feature of the Site;
- Submit false, misleading, unlawful, harassing, defamatory, or infringing content through any form or interactive feature; or
- Use the Site to impersonate any person or entity or to misrepresent your affiliation with any person or entity.
9. Third-Party Links and Services
The Site may contain links to third-party websites, platforms, resources, or services that we do not own or control, and it may reference or interoperate with third-party products. We provide these links and references for convenience only, and their inclusion does not imply our endorsement of, or responsibility for, the third party.
We are not responsible for the availability, content, accuracy, products, services, security, or privacy practices of any third-party site or service. Your access to and use of any third-party site or service is at your own risk and is subject to that third party's own terms and policies. We encourage you to review those terms and policies before engaging with any third party.
10. Disclaimers
The Site, the Content, and our offerings are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, DigixData disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any defects will be corrected.
Our Content and offerings are provided for general educational and informational purposes and reflect our opinions and experience regarding artificial intelligence and related topics. They do not constitute legal, financial, tax, investment, or other professional advice, and you should not rely on them as a substitute for advice from a qualified professional. Any decisions you make based on the Content or our offerings are your own responsibility.
Artificial intelligence outcomes depend on many factors outside our control, including your own systems, data, resources, personnel, and execution. We do not represent, warrant, or guarantee any specific business, operational, financial, or other results from adopting AI or from using our offerings. Any examples, case descriptions, or forward-looking statements are illustrative only and are not a promise of comparable results.
11. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will DigixData or its owners, officers, employees, contractors, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your access to or use of (or inability to access or use) the Site, the Content, or our offerings, whether based on contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Site, the Content, or these Terms will not exceed one hundred U.S. dollars (US $100.00). This limitation does not apply to liability that cannot be excluded or limited under applicable law, and it does not affect the terms of any separate written agreement governing a specific paid engagement, which sets out the liability terms for that engagement.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above exclusions and limitations may not apply to you. In such cases, our liability is limited to the greatest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless DigixData and its owners, officers, employees, contractors, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use or misuse of the Site or the Content, your violation of these Terms, or your violation of any law or the rights of any third party.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that matter.
13. Changes to These Terms
We may update or modify these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and post the updated Terms on the Site. Material changes may also be communicated through other reasonable means.
Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, please stop using the Site. We encourage you to review these Terms periodically so you stay informed of any changes.
14. Governing Law and Venue
These Terms and any dispute arising out of or relating to them or to your use of the Site are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any dispute that is not subject to a separate agreement will be the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision.
