This Trademark Notice explains which names, logos, and program titles DigixData claims as its trademarks and service marks, and how they may and may not be used. It applies to the entire DigixData website at https://digixdata.com and to all of our offerings, including our keynotes and speaking programs, workshops, enterprise AI consulting, self-paced courses, our book, and our browser extensions and plugins.
1. About This Notice
DigixData ("DigixData," "we," "us," or "our") is a company based in Frisco, Texas that provides AI-focused keynotes and speaking programs, workshops, enterprise AI consulting, self-paced courses, a published book, and browser extensions and plugins. This Trademark Notice governs the DigixData names, logos, program titles, and other brand identifiers (collectively, our "Marks") across our whole business and website, not just any single product line.
We publish this Notice so that customers, partners, event organizers, journalists, and the general public understand what our Marks are and how to reference them accurately. Nothing in this Notice is legal advice, and it does not grant you any license or right to use our Marks except as expressly described here.
2. DigixData's Trademarks and Service Marks
The following names and identifiers are trademarks or service marks of DigixData and are used to distinguish our goods and services in the marketplace:
- The "DigixData" name, our word mark, and the DigixData logo and any stylized or design versions of it;
- "RISE of the Agents"™, the title of our keynote and speaking program;
- "The Agentic Operator Playbook"™, the title of our book;
- The names of our workshops, self-paced courses, consulting programs, and browser extensions and plugins, as we may offer and name them from time to time; and
- Any taglines, slogans, and other brand identifiers we use in connection with our offerings.
3. Ownership and Common-Law Rights
Our Marks are owned by DigixData and are protected under applicable trademark and unfair-competition laws, including common-law rights arising from our use of the Marks in commerce. We use the "™" symbol to identify names and titles we claim as trademarks or service marks.
Except where we expressly state otherwise in writing, our Marks are claimed on a common-law basis and should not be assumed to be federally registered. Please do not use the federal registration symbol "®" with any DigixData Mark unless we confirm in writing that the specific Mark is federally registered. Our rights in the Marks are reserved, and this Notice does not transfer or waive any of them.
4. Acceptable Use of Our Marks
You may make truthful, factual references to DigixData and our offerings without our prior permission, so long as your use is accurate and does not create confusion about the source of goods or services or suggest a relationship that does not exist. When you refer to us, please follow these guidelines:
- Use our Marks only to refer accurately to DigixData and our actual products, programs, and services;
- Spell and capitalize our Marks correctly and use them as adjectives followed by the appropriate generic term (for example, "the DigixData website" or "the RISE of the Agents keynote") rather than as verbs or in the plural or possessive form of the Mark itself;
- Use our Marks in their standard form, without abbreviating, combining them with other names or Marks, or incorporating them into your own product names, company name, domain name, social media handle, or logo; and
- Make clear, where relevant, that you are an independent party and that your use is a reference to DigixData rather than an endorsement by us.
5. Uses That Are Not Permitted
To protect our brand and avoid confusing the public, you may not, without our prior written permission:
- Use our Marks in any way that implies DigixData's sponsorship, endorsement, certification, or affiliation, or that suggests a partnership or business relationship that has not been established in writing;
- Alter, distort, recolor, animate, or otherwise modify our Marks or logo, or use them in a manner that diminishes their appearance or legibility;
- Use our Marks in a false, misleading, confusing, disparaging, defamatory, or otherwise unlawful manner, or in connection with content that is unlawful, infringing, or objectionable;
- Register or attempt to register our Marks, or any confusingly similar name or logo, as a trademark, company name, domain name, social media account, or keyword; or
- Use our Marks in advertising, merchandise, or promotional materials, or in a way that trades on our goodwill, except as expressly authorized by us in writing.
6. Requesting Permission
If you would like to use any DigixData Mark in a way that is not clearly permitted by this Notice — for example, in marketing materials, co-branded content, merchandise, an event listing, or a partner integration — please contact us first to request permission. Please describe the specific Mark you want to use, how and where it will appear, and the purpose of the use.
We review requests on a case-by-case basis and may grant, condition, or decline permission at our discretion. Any permission we grant is limited to the specific use we approve and does not create an ongoing license or any rights beyond what we expressly authorize.
7. Third-Party Trademarks
Product names, service names, logos, and other marks that are not owned by DigixData and that appear on our website or in our materials are the property of their respective owners. We reference such third-party names and marks only for identification and descriptive purposes, and such references do not imply any affiliation with, sponsorship by, or endorsement by those owners.
All third-party trademarks remain the property of their respective owners, and their appearance in connection with DigixData does not grant you any right to use them. Some of our browser extensions and plugins, and other offerings, may reference or interoperate with third-party services whose names are trademarks of those third parties; each such extension may also carry its own detailed disclosures.
8. Changes to This Notice
We may update this Trademark Notice from time to time to reflect changes to our Marks, our offerings, or applicable law. When we make changes, we will revise the "Last updated" date shown above. Your continued use of our website or reference to our Marks after an update constitutes your acknowledgment of the current version of this Notice.
This Notice is governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and any dispute relating to it or to the use of our Marks will be subject to the exclusive jurisdiction and venue of the state or federal courts located in Collin County, Texas.
